PREMISE

These general conditions of supply apply in full to every order except for special written exceptions proposed and sent by Azienda Agricola Passerini di Passerini Sara to the Customer. The placing of the order implies the full acceptance of these general conditions of sale.

1. Definitions

   1. "Azienda Agricola Di Passerini Sara": is the company that sells products belonging to its assortment on the basis of production via the Internet.

  2.  "Products": are all products and / or goods produced and marketed by Azienda Agricola Di Passerini Sara and belonging to its assortment.

  3. "Customer": is the purchaser of the Products who holds the status of consumer, meaning the natural and legal person who makes the purchase for purposes not related to any commercial or professional activity carried out and as a reseller in the case in which the buyer makes the purchase for purposes related to any commercial or professional activity carried out.

  4. "Site": is the set of web pages relating to the address www.aziendadi Passerini Sara.it   

   5. "Promotions": are the sales made by Azienda Agricola Di Passerini Sara for all or part of the      Products or for limited periods of time with an extraordinary discount on the sale price.

  6. "Cart": is the purchase order with delivery of the Products in days following that of transmission of the order by the Customer to Azienda Agricola Di Passerini Sara

2. Scope - Effects

   1. The General Conditions are an integral part of any proposal, purchase order and purchase order confirmation of the Products marketed by Azienda Agricola Di Passerini Sara in force on the date of the relative order.

  2. The General Conditions concern exclusively the sale to the Customer.

  
3. Contract formalization

   1. All contracts are concluded exclusively with the access by the Customer to the site, using remote communication technology through the Internet.

  2. All purchase orders sent to Azienda Agricola Di Passerini Sara must be exactly completed in their entirety and must contain the elements necessary for the exact identification of the Products ordered, the Customer and the place of delivery of the Products, and are subject to upon approval by the Company, which reserves the acceptance of the order and the communication of any changes before the final approval of both parties.

  3. The purchase order sent to Azienda Agricola Di Passerini Sara is valid as a contractual proposal of the Customer expressed online.

  4. Azienda Agricola Di Passerini Sara reserves the right not to accept orders that are incomplete or not properly completed.

  5. Azienda Agricola Di Passerini Sara reserves the right to make the online sale to users registered on the site or who have provided the required general information.

  
4. Delivery times and methods

  Azienda Di Passerini Sara provides two types of delivery:

  Shipping to the address provided by the customer at the time of order confirmation

• Azienda Agricola Di Passerini Sara delivers the selected and ordered Products to the Customer, in the manner referred to in the previous article, by means of trusted couriers and / or shippers.

• Delivery is made to the address specified at the time of the order which may be different from the customer's address, in case of non-presence of the recipient at the times indicated in the ordering Azienda Agricola Di Passerini Sara reserves the right to charge additional delivery costs to the client.

• In any case, the delivery times, according to the provisions of art. 6 of Legislative Decree no. 185/1999, are not more than 30 days from the day following that of transmission of the order to Azienda Agricola Di Passerini Sara or from receipt of the advance bank transfer.

• The Customer who wishes to change the delivery address of the goods, after having placed the order, can contact the Customer Service at +39 3404161112 - or at the E-Mail address commerciale@aziendapasserini.it , specifying the method of purchase of the goods and request a change of address: the request will be accepted if the order has not yet been processed.

• The delivery costs of the Products are charged to the Customer.

• The delivery of the Products is subject to the payment, by the Customer, of the relative price with the means chosen among those made available by Azienda Agricola Di Passerini Sara.

Home delivery

It is also possible to take advantage of home delivery with the following rates:

Domicile in Florence, Scandicci, Sesto Fiorentino, Bagno a Ripoli: the cost is 2 euros within 40 euros, plus free.

Domicile outside Florence (within 50 km): the cost is 5 eur

In all other cases the cost is 12 eur

Direct collection of the goods at Azienda Agricola Di Passerini Sara headquarters or at agreed collection points

• The Customer can collect the ordered goods, upon agreement between the parties, at the Azienda Agricola Di Passerini Sara headquarters or at one of the collection points affiliated with it.

• The choice of this method can be made during the order confirmation phase and cannot be revoked.

• As soon as the order is received with the aforementioned delivery method, Azienda Agricola Di Passerini Sara will contact the Customer via email to agree on the place, date and time of collection of the ordered goods.

• The availability of the ordered goods may vary according to the chosen collection point. The collection points are listed below with the number of (indicative) working days within which the goods can be collected.

  - Company headquarters: via Del Porto 65 loc. Padolecchie, 53049, Torrita di Siena (SI) (3 days)

  -  Florence 1: via Francesco Domenico Guerrazzi 11, 50132, Florence (3 days)

  - Florence 2: via Giovanni Boccaccio 44 c / o Equolab srl, 50041, Calenzano (FI) (3 days)

• This withdrawal method has no cost for the customer

5. Prices

   1. All sales prices of the Products indicated on the Site are expressed in Euros and include VAT.

  2. The prices of the individual Products, indicated on the Site from time to time, cancel and replace the previous ones.

  3. The prices applied are those indicated on the Site at the time of the purchase order by the Customer.

6. Responsibility of Azienda Agricola Di Passerini Sara

   1. Azienda Agricola Di Passerini Sara assumes no responsibility for the use that the customer intends to make of the goods purchased.

  2. In the event of defective and / or damaged goods attributable to the courier, Azienda Agricola Di Passerini Sara will carry out the replacement only for the packages indicated on the courier's delivery receipt. In the case of resellers, Azienda Agricola Di Passerini Sara will not be held responsible for the Customer's loss of earnings.

  3. Azienda Agricola Di Passerini Sara declines all responsibility after 5 days from delivery for damaged products that have not expired, for which it is not possible to trace the methods of conservation.

  4. Azienda Agricola Di Passerini Sara assumes no responsibility for inefficiencies attributable to force majeure of any nature and kind, if it fails to execute the contract within the time agreed. Acts of force majeure are, by way of example and not limited to, the provisions of the Public Authority, the general or non-general strike of its employees or of the carriers of which Azienda Agricola Di Passerini Sara uses, as well as any other circumstance that is beyond the control of the latter, including delays in delivery not directly attributable to Azienda Agricola Di Passerini Sara.

  

7. Obligations of the customer

   1. The Customer undertakes, once the online purchase procedure has been completed, to print and keep these General Conditions.

  2. The information contained in the General Conditions must be viewed and accepted by the Customer before sending the purchase order, in order to fully satisfy the condition referred to in Articles. 3 and 4 of Legislative Decree no. 185/1999. Acceptance takes place by marking the appropriate space on the site. Failing this, the order cannot be executed.

  

8. Right of withdrawal

   1. The Customer who wishes to cancel the order sent, can contact the Customer Service at +39 340 4161112 or at the E-Mail address commerciale@aziendapasserini.it : the request will be accepted if the order has not yet been processed and, in any case for non-perishable, personalized or food goods as required by current legislation.

  2. Pursuant to art. 5 of Legislative Decree no. 185/1999, the Customer who for any reason is not satisfied with the purchase made, has the right to withdraw from the stipulated contract and to return any ordered Products already delivered, without any penalty and without specifying the reason; are excluded from this for perishable, personalized or food goods as required by current legislation.

  3. The right of withdrawal must be exercised by the Customer, under penalty of forfeiture, by sending a registered letter with return receipt to Azienda Agricola Di Passerini Sara, Via Francesco Domenico Guerrazzi, 11 - 50132 Florence, within ten working days of receipt of the Products.

  4. If the withdrawal is made in compliance with the conditions indicated above, the amount paid for the Products and the delivery costs is credited to the purchaser at his choice by bank transfer to an account in his name.

  5. The reimbursement is free and is carried out as quickly as possible, and in any case within 60 days from the date on which Azienda Agricola Di Passerini Sara becomes aware of the Customer's exercise of the right of withdrawal.

  6. Returned products must be received by Azienda Agricola Di Passerini Sara within 30 days from the delivery date.

  7. Returned Products must be returned intact, unused and in the original packaging. Penalty the forfeiture of the withdrawal.

  8. The only costs charged to the Customer for exercising the right of withdrawal are those for returning the Products to Azienda Agricola Di Passerini Sara.

  

9. Product warranty

   1. The customer who purchases from Azienda Agricola Di Passerini Sara has the right to return the purchased products and request the replacement of the goods in case of their possible damage during transport or breaking of the seals. This right must be exercised by the Customer, under penalty of forfeiture, no later than two days from receipt of the package, by contacting Azienda Agricola Di Passerini Sara as indicated in point 13.2. and clearly marking the conditions of arrival of the goods on the delivery note.

  

10. Promotions

   1. The Promotions proposed by Azienda Agricola Di Passerini Sara are valid until stocks of the Products are exhausted and within the purchase limits indicated on the Site, where specified, and in any case in the time frame in which the promotion will be present on the pages of the site.

  2. The Promotions are cumulative, unless otherwise specified.

  3. No replacement or return is possible in relation to any Products received as a gift from the Customer.

  

11. Disputes

   1. Any dispute relating to the application, execution, interpretation and violation of the contract stipulated online by the Customer with Azienda Agricola Di Passerini Sara, is subject to Italian jurisdiction.

  2. For any dispute between the parties in this regard, the Court of the place of residence or domicile of the Customer is competent, if located in the Italian territory.

  3. If the Customer's domicile or residence is not within the Italian territory, the competent court is that of execution of the contract.

  

12. Applicable law and referral

   1. The contracts stipulated online by the Customer with Azienda Agricola Di Passerini Sara are governed by Italian law.

  2. Although not expressly provided for here, the laws applicable to the relationships and cases provided for in the contract stipulated online by the Customer with Azienda Agricola di Passerini Sara are valid. Pursuant to art. 1341 and 1342 of the Civil Code, the Customer declares to have read carefully and to accept expressly and in particular the following clauses of the General Conditions of Sale of Azienda Agricola Di Passerini Sara: 6. Responsibility of Azienda Agricola Di Passerini Sara; 8. Right of withdrawal; 9. Product warranty; 11.6 Prohibition to return free products; 12. Disputes; 13. Applicable law.

13. Shipping

Azienda Agricola Di Passerini Sara will ship the products ordered by the Customer, by courier, to the address indicated by the same, approximately within 48 hours from the acceptance of the order, except for holidays.

Shipping costs are:

- € 9.50 for orders from 0Kg to 5 kg
- € 12 for orders from 5.01 kg to 15 kg
- € 15 for orders from 15.01 kg to 30 kg

- € 18 for orders from 30.01 Kg to 50Kg

Delivery generally takes place within 3 working days following receipt of payment. 

Orders received on Saturday and Sunday will be processed on the following Monday; orders received during public holidays will be processed the next working day. In any case, delivery times are provided for indicative purposes only and are therefore not binding.

The courier is responsible for the delivery. Azienda Agricola Di Passerini Sara undertakes to collect any reports of non-delivery or delayed delivery of the products through the Customer Service and, if necessary, to assist the Customer in protecting their rights as required by law.

The courier in charge will make a delivery attempt during the day, if he does not find anyone at home he will leave a non-delivery notice note which will contain a telephone number to contact.

For shipments to the territory of San Marino and the Vatican City, the recipient of the goods is responsible for paying the taxes and customs duties provided for by the legislation in force in the territory of destination of the products.

14. Methods of payment

before accepting the order, the Customer must choose one of the following payment methods available on www.aziendapasserini.it:

Cash payment can be made by coming to collect the goods at the collection points listed below:

once the order is confirmed, the Customer will be contacted by Azienda Agricola di Passerini Sara to agree on the date, time and place of collection.

PAYPAL

PayPal is an online payment system that allows any company or consumer with an email address to send and receive payments. By registering for free, you can open your account that allows you to make payments using your email and password. You can associate a credit card or a prepaid card to your account, or you can top up your bank account without charge.

If PayPal is selected, the Customer must follow the procedures on the Pay Pal site.
The customer will be redirected to the transaction page of the PayPal payment institution which will take care of its security.
At the end of the transaction, the Customer will return to the order confirmation page.

WIRE TRANSFER

In case of selection of the "offline" payment method, the Customer can decide whether to make the payment in cash or by bank transfer. If you choose this last option, you will have to make a transfer to the bank details found on www.aziendapasserini.it. These bank details will also be sent to the Customer, together with the copy of the order, by e-mail. Proof of payment is given by crediting the amount of the transfer to the Seller's current account.
